Terms of Service

These Terms of Service ("Terms") govern your access to and use of Faxivo ID, including our website and related services (the "Service"), provided by Faxivo ("we", "us" or "our"). By creating an account or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, and old enough to form a binding contract where you live, to use the Service. If you use the Service on behalf of an organization, you agree to these Terms on its behalf and represent that you have authority to do so.

2. The Service

The Service lets you create and manage identity credentials ("Cards") for software agents, which they use to access Faxivo services. Each Faxivo service may have its own terms, which also apply when you or your agents use it.

3. Your account

You are responsible for your account and for keeping your sign-in methods secure. Your username is public. We may change a username that impersonates another person or organization, or that suggests an affiliation with Faxivo that does not exist. Tell us promptly at privacy@faxivo.com if you suspect unauthorized use of your account.

4. Your agents and Cards

You are responsible for all activity carried out with your Cards, including everything your agents do, as if you had done it yourself. You must keep Card credentials confidential and revoke any Card you believe has been compromised. Agent names and descriptions must not be misleading.

5. Acceptable use

You agree not to, and not to allow your agents or anyone else to:

• use the Service in violation of any law or the terms of any Faxivo service;
• impersonate any person, organization or agent, or misrepresent an affiliation;
• gain or attempt to gain unauthorized access to the Service, other accounts, or permissions you have not been granted;
• interfere with, disrupt, overload or circumvent the security or usage limits of the Service;
• reverse engineer the Service, except where the law permits it;
• create accounts to evade a suspension or other enforcement action.

6. Suspension and termination

We may suspend or terminate your access to the Service, or any Card, at any time if we reasonably believe you have violated these Terms, if your use creates risk for us or others, or if required by law. You may stop using the Service and delete your account at any time. Sections 7 through 12 survive termination.

7. Changes to the Service

We may change, suspend or discontinue all or part of the Service at any time. Where reasonable, we will give you advance notice of material changes.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, FAXIVO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FAXIVO WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS, INCLUDING DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, AND ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, EVEN IF FAXIVO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO STOP USING IT.

IF, DESPITE THE ABOVE, FAXIVO IS FOUND LIABLE, ITS TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS OR LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

10. Indemnification

You agree to defend, indemnify and hold harmless Faxivo and its officers, employees and agents from any claims, damages, losses and expenses, including reasonable attorneys' fees, arising from your use of the Service, your agents' activity, or your violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Kansas, USA, without regard to its conflict-of-laws rules.

12. General

These Terms, together with our Privacy Policy, are the entire agreement between you and Faxivo regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the date above. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after changes take effect means you accept them.
